Dan,

I am glad that the LegalXML SC has agreed with the proposed wording for
Section 5 of the OASIS LegalXML Court Filing TC.  However, I am disturbed by
some of the statements you made which I believe deserve a response for
clarification.

1) "I don't like the idea of changing our pre-agreed wording at all."
As was noted in the attached email, I asked our attorney to halt work on
review/modification of the "pre-agreed wording" back on Feb. 15th, until the
LegalXML SC was in place and the first TC Charter was submitted. So,
additional minor adjustments (without changing the intent) to the
"pre-agreed wording" was predicted and expected 3 months ago.  Now that our
Board has reviewed the wording and our corporate legal counsel has had the
opportunity for further reflection, it appears that we have wording that ALL
parties can support!

2) "... IBM's ebXML IP games at OASIS ..."
Please do not refer to any member's rightful disclosure of a legally granted
patent as "games".  IBM has disclosed their patents and subsequently
declared their intent to offer royalty-free licenses against those patents.

3) "Also, which member of the Board is pushing back?"
It really doesn't matter which individual OASIS Board Director raised the
question about the TC Charter. I agreed that the question raised deserved
review and our legal counsel, upon review of the question, concurred that a
change in the wording was warranted.


So, in the spirit of unity that we have all worked hard to achieve, let us
move forward with this TC Charter.  Our staff is committed to supporting the
LegalXML SC and each of the TCs created under the LegalXML Member Section.
I have appreciated the individual counsel which I have sought and gratefully
received from members of your SC as I go forth to speak to various
constituents about the rapidly growing work of OASIS and LegalXML,
especially in the public sector.  It is our intent to actively promote your
work and attract many more members to join and support your activities.  The
OASIS staff efforts to jointly support LegalXMl and our Election & Voter
Services TC at the upcoming IACREOT conference is another example of these
efforts.
